     In July of 2004, Mr. Boothe obtained a not guilty verdict after a jury trial for a client charged with possession of a firearm by a convicted felon, thereby avoiding a three (3) year mandatory prison sentence.

     Additionally, in October of 2004, Mr. Boothe obtained a not guilty verdict after a Jury Trial for a client in Hamilton County, Florida on felony D.U.I. charges where the client gave breath test results of .196 and .205, allowing the client to a avoid a six (6) month jail sentence and a ten (10) year driver's license revocation.

     Finally, in December of 2004 Mr. Booth obtained a not guilty verdict in Lafayette County, Florida for a man facing life in prison for the charge of Burglary of a dwellig while armed with a firearm.

Jury acquits former Avis worker
:  A former Avis employee charged with letting his then-girlfriend joyride in a rental car this May was acquitted Tuesday by a Leon County jury.  Robert Walker, 23, of Tallahassee, was found not guilty on one count of grand theft auto, said his attorney, Dennis Boothe.  He surmised that jurors acquitted after 2 ½ hours because of a lack of evidence supporting the girlfriend’s story – that Walker “hooked her up” with the 2004 Oldsmobile Alero.  Assistant State Attorney Georgia Cappleman, who prosecuted Walker during the one-day trial, could not be reached for comment Tuesday evening.  Walker, a Florida State University evening criminal justice student, now has a new girlfriend, Boothe added.

Our firm, and Dennis E. Boothe, Esq., in particular, are having great years in 2003 and 2004. We have been extremely busy with numerous successful trials and court motions, for matters from DUI to sexual battery defense.

In a recent DUI case, an orthopedic surgeon from Orlando hired our firm based on our reputation for successful defense of so many DUI clients in the past. This Orlando client had crashed his 2003 luxury car into a median strip light pole, totaling his car. When the police arrived at the accident scene, our client was behind the wheel of his car, and the keys were still in the ignition. Our client cooperated completely with the police, agreed to a blood alcohol test, and was found to have a blood alcohol level in excess of .20. Mr. Boothe was successful in getting the charges against our client dismissed because when the police had arrived at the scene our client's crashed car was undrivable, and since he was alone at the scene and no one had asked our client if he had been the one driving the car a the time of the accident!

In a Federal Court drug trial involving the largest methamphetamine bust in the history of the big bend area, Mr. Boothe got a not guilty verdict on behalf of a client who had already confessed her of her participation on the record. Our client, who was from Texas, agreed to help her neighbor drive from Texas to Altanta to visit his daughter. On the way back from Atlanta, the neighbor stopped at a truck stop under the pretext of meeting someone who had a construction job for him. What he really did was make a drug deal (with a police officer) that resulted the transfer of $330,000 worth of meth that was found in the car with our client and her neighbor. Our client was arrested and charged with numerous federal crimes. After we were retained, Mr. Boothe successfully defended our client by getting the DEA interpreter to admit that he may have mistakenly interpreted our client's "confession," and that she may never have known that the drugs were in her neighbor's vehicle.

Quincy - Man acquitted in attempted-murder case:
A Gadsden County jury Tuesday acquitted a Quincy man of attempted-murder charges, his lawyer said.  Maurice Herring, 31, had been charged in the June 2003 stabbing of Mike Williams, 29, in a bar fight at a north Gadsden County tavern, attorney Dennis Boothe said.  None of the witnesses could say they saw Herring stab Williams, though some said they saw Herring with a knife in his hand, according to Boothe.  After an hour of deliberation, jurors convicted Herring on one misdemeanor battery charge, and Circuit Judge William Gary sentenced him to six months in jail, Boothe said.  Assistant State Attorney Lorena M. Vollrath-Bueno, who prosecuted the case, could not be reached at her office. 

In addition, Mr. Boothe and his associates have settled numerous personal injury cases for the policy limits so far this year.

While our firm does not win then all, we do win our share. We can't wait to see what the remainder of the year will bring!
